ENERGY STAR Quantity Quotes Web site provides only a means through which procurement needs may be communicated to potential suppliers and for suppliers to respond to those requests. Users agree and understand that this site operates only as a venue for entering into transactions and that the participating suppliers are neither owned nor controlled by the U.S. Department of Energy (DOE).

If you are a purchaser, you understand and agree that you assume full and sole responsibility for the use of this site. YOU AGREE THAT YOU HAVE, AND WILL HAVE, NO CLAIM OR RIGHT OF ACTION OF ANY KIND AGAINST DOE IN CONNECTION WITH ENERGY STAR QUANTITY QUOTES OR YOUR USE OF THIS SYSTEM. If you are a purchaser, you agree that it is solely your responsibility when using this system to comply with all applicable local, state and federal statutes, ordinances, regulations, and policies governing the purchase of goods or services by your agency. DOE shall have no responsibility for ensuring that purchases of goods or services using this system will comply with such laws, ordinances, regulations, and policies.

If you are a supplier, you understand and agree that all products marketed on the site must meet the prevailing ENERGY STAR criteria for their respective product category. Product(s) must be packaged for delivery to the purchaser or end-user in accordance with commercial packaging and labeling requirements in the ENERGY STAR specification for that product(s). Further, as a supplier, you understand and agree to deliver products to the purchaser or end-user specified by the purchaser by the date determined by the purchaser and supplier. The purchaser is not responsible for payment of the product if it is not delivered as agreed.

DOE 1) DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, RELATING TO ANY TRANSACTION ENTERED INTO BETWEEN A PARTICIPATING AGENCY AND A SUPPLIER; AND 2) DOE FURTHER DISCLAIMS ALL WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, CONCERNING INFORMATION SUPPLIED, OR REPRESENTATIONS MADE, BY ANY SUPPLIER, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OR REPRESENTATION RELATING TO PRODUCT SUITABILITY, RELIABILITY, OR AVAILABILITY, TIMELINESS OF DELIVERY, OR THE TRUTHFULNESS OR ACCURACY OF ANY OTHER INFORMATION OR REPRESENTATION MADE OR SUPPLIED BY A SUPPLIER.

DOE reserves the right to terminate your access to the site or to any or all of its services at any time. In event of such termination DOE shall have no responsibility to notify third party providers of service or other users. Cause for termination shall include, but not be limited to:

• Placement of product that is not ENERGY STAR qualified by prevailing specifications
• Placement of sub-standard or damaged product
• Failure to meet one or more terms of purchasing agreement(s)
• Failure to deliver product in the timeframe specified

You agree that any information you provide about yourself or your agency when registering to use ENERGY STAR QUANTITY QUOTES or subsequent to registration is true, accurate, current and complete and that you will maintain and update that information to ensure that it remains true, accurate, current and complete. If DOE suffers any claim or incurs any liability as a result of information entered into the site by users of your agency's account, your agency will indemnify DOE against such claim or liability including costs and attorneys fees incurred in defending against it.

DOE may from time to time amend these Terms and Conditions of Use. In the event of any such amendment, system users will, as a condition to further use of ENERGY STAR Quantity Quotes, be required to acknowledge and agree to the amendment.
